Please read these Terms and Conditions carefully before entering the Competition and be aware that by entering the Competition, you agree to be bound by them.

All correspondence related to the Competition must be marked for the attention of The Promoters, Inch of Insch Competition, Insch Golf Club at the above address.
The Competition has been approved by Aberdeenshire Council under the terms of the Small Society Lotteries section of the Gambling Act 2005.
The Promoters and sole arbitrators in relation to the Competition are Mr Allan McGillivray (Captain) and Mr Bernard Vincent (Vice Captain) of Insch Golf Club.
The principal purpose of the Competition is to provide a game of chance to those entering the Competition and to raise funds for Insch Golf Club.
The Competition is open to anyone aged 18 or over excluding the Promoters, their immediate family, employees of Insch Golf Club or anyone else connected with the development or operation of the Website or with the administration of the Competition.
The Competition is internet based and the principal method of entry is online (see offline entry method below) at www.inchofinsch.co.uk.
The minimum entry online will be 9 (nine) squares for £9; there is no maximum level of entry.
A grid comprising 24,336 (twenty-four thousand three hundred and thirty-six) squares is presented on the Website; this grid forms a representation of the 18th green at Insch Golf Course. For ease of presentation on the Website the grid is sub-divided into 36 equal sub-sections.
An offline (paper) entry form will be available from Insch Golf Club. Entrants will indicate the general area where they wish to reserve grids and the Competition administrator will manually register entries as close to the area of selection as possible. The minimum entry offline is 1 (one) square for £1.
Each square will represent an area of 3 (three) square inches of the 18th green.
Entrants will choose to reserve squares on the grid and those squares will remain reserved for the duration of the Competition.
At a date to be specified (see "Competition Closing Date" below) a golf professional will be invited to hit balls from the Medal Tee of the 18th Green at Insch Golf Club (approx 162 yards/148 metres) to the 18th Green. Each ball coming to rest within the designated area of the green will be marked and measured by independent Adjudicators to determine the grid reference.
The grid references will then be matched by the Adjudicators and the Promoters to the entry details known only to them.
The winners will be announced immediately the ball and grid positions have been checked and verified.
Any ball landing on a grid square that has not been reserved will be deemed to have landed on the grid square closest to that position.
Any ball measured on a line between two grid squares or at the intersection of four grid squares will result in the prize for that position being equally divided amongst the registered entrants of those grid squares.
As a condition of entering the Competition, Entrants must ensure that, by doing so, they do not contravene any laws of their country of residence. The Promoter will not be liable in any way if an Entrant enters the Competition unlawfully.
Entry to the Competition in no way signifies ownership of the area designated by the grid representing the 18th green at Insch Golf Club.
By entering into the Competition, all Entrants acknowledge that their payment of the Entry Fee per Entry does not guarantee in any way that they will win the Prize.
The Entry Fee is payable using the "Go to Checkout" button on the grid selections page of the Website.
To submit an Entry into the Competition, an Entrant will be asked to provide their contact details (including postal and e-mail addresses and a telephone number) and card payment details. Once the Entry is submitted, the Entrant's card payment will be electronically approved.
Online entry to the Competition and acceptance as a Valid Entry will only be confirmed upon approval of the payment and by the sending of the combined confirmation e-mail and receipt as described above by the Promoters to the Entrant to confirm their entry into the Competition.
All Entrants are solely responsible for providing the Promoters with accurate and current contact details and for notifying any changes to contact details already supplied.
The Promoters will be in no way liable for any failure or inability to make contact with any Entrant due to any errors, omissions or inaccuracies in the contact details provided by the Entrants or otherwise.
Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this Competition.
When the Maximum Number of Entries or the Closing Date is reached whichever is the sooner, the Competition will close.
The closing date will not be later than 31 March 2011 and will be announced on the Website and notified by email to all entrants whose valid email address is held.
All Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date.
A total of 6 (six) prizes will be awarded.
The guaranteed minimum for each prize will be £500.
The prize fund for the first and second balls to be marked and measured as coming to rest within the grid on the 18th green at Insch Golf Club will be increased according to the level of sales to a maximum of £4,000 for first prize and £2,000 for second prize. The four remaining prizes will be £500.
The Promoters will publish monthly updates of the prize levels on the competition Website.
If the Winner cannot be contacted by the Promoter using all reasonable endeavours within 90 days of the Promoter notifying the Winner of their status as the Winner by e-mail, telephone and mail using the contact details submitted in their Entry, the Promoter shall award the Prize to the Entrant who has reserved a grid square closest to the winning entry.
The Competition administration cost will cover (1) Website development (2) Website hosting (3) internet and traditional marketing (4) payment processing fees and bank charges only. No personnel costs from Insch Golf Club will be allocated to the Competition administration fee. The budget for administration costs is £4,000.
A maximum level of revenue to be accepted for the Competition will be £20,000 (allowing for bonus entries); after the deduction of administration costs, assuming a full sale, the remaining £16,000 would be split equally between the Prize Fund and Insch Golf Club.
The Entrants and the Promoters recognise that the Promoters may use contact details and other data including personal data as defined by the Data Protection Act 1998 supplied by the Entrants to the Promoters to administer the Website and conduct the Competition according to these Terms and Conditions.
The Entrants and the Promoters recognise that the Promoters may disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.
The Winner agrees to allow the Promoters to display his or her name on the Website in accordance with the Privacy Policy. The name, age and town of residence of the Winner will be posted on the Website for the purposes of announcing the Winner of the Competition within 24 hours of the Winner being determined
The Promoters reserve the right to cancel or amend the Competition and the Terms and Conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation outside the Promoter's reasonable control. The promoters also reserve the right to cancel the Competition at any time prior to 30 June if, in the sole opinion of the promoters, the Competition is poorly subscribed.
If the Competition is cancelled, the Promoters will return the Entry Fees to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person.
The Promoters accept no liability for errors or omissions contained within the description of the Competition or specification or any other part of the Website. It is the responsibility of each Entrant to satisfy him or herself as to the accuracy of any such details.
The Promoters do not accept responsibility for Entries which they do not receive due to failures in hardware failure, software failure, server faults or any other reason.
It is the responsibility of Entrants to contact the Promoters if you do not receive the combined confirmation e-mail and receipt as described above within 5 days of the submission of any Entry.
These Terms and Conditions shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoters.
An Entry shall be declared void if the Entrant is under 18 years or age or engages in any form of fraud or hacking or interference with the functioning of the Website.
These Terms and Conditions shall be governed by and construed in all respects in accordance with the laws of Scotland and the parties hereby submit to the exclusive jurisdiction of the Scottish courts.
The structure and design of this Website is protected by copyright and is owned by Insch Golf Club. No use of the code of the Website is permitted without the written agreement of Insch Golf Club.
